nga3D provides additive manufacturing (3D printing) services, including but not limited to rapid prototyping, production manufacturing, on-demand printing, and related design and consultation services. Our services may include:

  • Material selection consultation
  • Post-processing and finishing services
  • Small batch production

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information. You are responsible for safeguarding your account credentials and for any activities or actions under your account. We reserve the right to disable any user account at any time if, in our opinion, you have violated any provision of these Terms.

4. Intellectual Property Rights

You retain all rights to any content, designs, files, or information you submit to us ("Your Content"). By submitting Your Content to us, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display Your Content solely for the purpose of providing our services to you.

All content, features, and functionality on our website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are owned by nga3D or our licensors and are protected by copyright, trademark, and other intellectual property laws.

4.3 Prohibited Uses

You agree not to use our services to:

  • Infringe upon or violate the intellectual property rights of others
  • Create or manufacture illegal items or weapons
  • Create or manufacture items that violate safety regulations
  • Reproduce trademarked or copyrighted items without proper authorization

5. Order Process and Payment

5.1 Quotes and Pricing

All quotes provided are based on the information you provide. Prices may vary based on material selection, quantity, complexity, finishing requirements, and other factors. Quotes are valid for 30 days unless otherwise specified.

5.2 Payment Terms

Payment terms will be specified in your quote or invoice. For new customers or large orders, we may require a deposit before beginning work. All payments are non-refundable once production has begun, unless otherwise agreed in writing.

5.3 Shipping and Delivery

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers or circumstances beyond our control. Risk of loss transfers to you upon shipment from our facility.

6. Quality and Warranties

6.1 Quality Standards

We strive to deliver high-quality products that meet industry standards. However, 3D printing has inherent limitations, including potential variations in color, texture, and dimensional accuracy. We will make reasonable efforts to match your specifications, but some variation is normal and expected.

6.2 Limited Warranty

We warrant that our products will be free from material defects in workmanship at the time of delivery. This warranty does not cover defects resulting from improper use, normal wear and tear, or design issues in your submitted files.

6.3 Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED HEREIN, OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL NGA3D BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless nga3D and our officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of our services
  • Your violation of these Terms
  • Your violation of any rights of another
  • Your submitted content or designs

9. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without giving effect to any principles of conflicts of law. Any dispute arising from or relating to these Terms or our services shall be resolved exclusively in the courts located in Georgia.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make changes, we will provide notice by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such changes constitutes your acceptance of the new Terms.

11. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
